GENERAL TERMS AND CONDITIONS

  • 1 Scope of Terms

Li-Chauffeur offers its services exclusively based on these General Terms and Conditions (GTC). These apply to all offers and contracts within the framework of current and future business relationships, even if not explicitly mentioned again. By using the services, these GTC are considered accepted. Any deviating terms and conditions from the customer are hereby rejected unless there is a written agreement between the parties. Individual agreements take precedence over these GTC. Corresponding agreements must be in writing to be valid. Unless otherwise agreed, statutory provisions apply. References to legal regulations are purely informational.

 

  • 2 Offers and Contract Conclusion

Li-Chauffeur provides chauffeur services as well as the rental of high-quality vehicles. The customer’s order for services constitutes a binding offer. Li-Chauffeur is entitled to accept this offer within 30 days after receipt. Acceptance can be made in writing or by providing the service. Offers from Li-Chauffeur are non-binding unless explicitly marked as binding.

 

  • 3 Provision of Services

Li-Chauffeur is not liable for the impossibility of service if it is caused by force majeure or unforeseeable events (e.g., strikes, delivery delays) for which Li-Chauffeur is not responsible. Customers will be informed promptly of such circumstances. Service delays are to be treated according to statutory provisions. A reminder by the customer is required.

 

  • 4 Prices and Payment Terms

Unless otherwise agreed, the prices of Li-Chauffeur apply according to the price list, which is available on request. The customer is obliged to pay the compensation specified in the offer or contract, plus statutory VAT. Payments are to be made exclusively to Li-Chauffeur’s account. Discounts are only possible by written agreement. Complaints must be submitted in writing within 14 days. Li-Chauffeur may request advance payments or deposits, particularly for contract values over 8,000 euros. Payment terms apply from the provision of the service. In case of delays, interest can be charged according to statutory provisions. Price adjustments due to changes in wages or material costs are reserved. In case of a price increase of more than 10% for raw materials, the parties will negotiate a new price. A 5% fee will be charged for payments by credit card.

 

  • 5 Cancellation and Cancellation Fees

In case of cancellation by the customer, already incurred costs may be charged. The cancellation conditions are as follows:

Within 48 hours before provision: 50% of the agreed price

Within 24 hours before provision: 100% of the agreed price

For events, roadshows, and long-distance trips outside Munich, separate conditions apply:

Within 48 hours before provision: 75% of the agreed price

Within 24 hours before provision: 100% of the agreed price

For large events, different cancellation conditions and prices may apply. Large events are organized meetings with a large number of participants. Both parties have the right to terminate the contract without notice for an important reason. In the event of the customer’s insolvency, Li-Chauffeur may also terminate the contract without notice. Cancellations must be in writing, and transmission via fax is sufficient. Li-Chauffeur may terminate the contract if force majeure makes the provision of the service impossible. In the case of temporary obstacles, service dates will be postponed accordingly.

 

  • 6 Customer’s Cooperation Obligations

The customer must cooperate in a timely manner and accept the agreed services at the designated location. If the customer fails to do so, they will bear the additional costs. Li-Chauffeur’s vehicles may not be used for illegal activities or dangerous transport. The customer may not instruct the driver to engage in prohibited actions.

 

  • 7 Set-off and Right of Retention

The customer may only set off claims that are legally enforceable or undisputed. The customer is only entitled to exercise a right of retention if the claims are based on the same contractual relationship.

 

  • 8 Reservation of Right to Change

Li-Chauffeur reserves the right to provide a different vehicle if the ordered vehicle is not available. In case of a vehicle from a lower price category, the customer is entitled to a price reduction.

 

  • 9 Liability

Claims for damages are excluded unless Li-Chauffeur acts intentionally or with gross negligence. In case of simple negligence, Li-Chauffeur is liable only for significant breaches of duty. Liability for consequential damages is excluded. The customer is fully liable for damages caused by illegal use.

 

  • 10 Creditworthiness and Insolvency

Li-Chauffeur may only provide services against advance payment if the customer’s creditworthiness is in question. In the event of the customer’s insolvency, Li-Chauffeur is entitled to withdraw from the contract.

 

  • 11 Text Form

Changes and additions must be made in writing; oral agreements are only valid if the written form clause is waived.

 

  • 12 Luggage

The customer is entitled to have luggage transported as long as this is safely possible and permitted within the reserved vehicle size. Dangerous substances and substances prohibited in transit countries are excluded from transport.

 

  • 13 Damage and Soiling

The passenger is liable to the carrier for damages and soiling of the carrier’s vehicle that go beyond the usual wear and tear and soiling expected from the vehicle’s intended use. In case of excessive soiling, such as a passenger vomiting in the vehicle, the carrier is entitled to charge a special cleaning fee of 1,500 euros. Additional costs may arise due to vehicle downtime. Smoking is strictly prohibited in the vehicles of the carrier. In case the passenger or their companions violate this rule, the carrier reserves the right to charge the passenger for the special cleaning costs.

 

  • 14 Data Protection

Li-Chauffeur commits to protect all personal data of the customer in accordance with the provisions of the General Data Protection Regulation (GDPR). The customer agrees that their data will be processed to fulfill the contractual relationship. Data will only be shared with third parties if necessary for contract execution.

 

  • 15 Dispute Resolution

In the case of disputes arising from the contractual relationship, both parties are obliged to initially attempt to reach an amicable resolution. If this fails, the option of utilizing a mediation procedure according to statutory provisions is available.

 

  • 16 Jurisdiction

The place of jurisdiction is Ebersberg if the customer is a merchant. Li-Chauffeur may also file claims before the court responsible for the customer’s location.

  • 17 Governing Law

The contractual relationships are governed by German law, even if the customer is located abroad.

 

  • 18 Severability Clause

If individual provisions are ineffective, the remaining provisions remain valid. Invalid provisions will be replaced by regulations that come closest to the original purpose.
